the patient has three deadlines he knows he has to meet. yet others have appeared either not to notice. he must convert to medicare part d by may 15th or face penalties. by december 31 he must convert to a medicare health supplement. in his agreement when he got cobra there are also provisions for converting the insurance over. this is not being done. in any event his monies to pay for the insurance will run out at the same time his cobra coverage ends. his condition does not appear to be effective for local work, though he is doing fairly well when accessing the computer to take and upload photos and comments.

his other consideration is that technically since his mother has not probated his father’s will the failure to act clause is operative since real property of significant value is not yet assigned.
